Madonna Found Guilty Of Plagiarism
Posted by: Andy on Tuesday, 21st November, 2006No, it’s not over Hung Up, we’re sure she’s paid up all the correct fees to allow her to sing over that loop from Abba’s Gimme Gimme Gimme (A Man After Midnight), this case goes back a bit further to her 1998 single Frozen.
Belgian songwriter Salvatore Acquaviva claims that Frozen copies one of his songs, Ma Vie Fout L’camp, and this claim has now been upheld by a Belgian court.
The judge agreed that four bars of Acquaviva’s song were lifted directly by Madonna to create over half of Frozen.
The ruling means that Frozen is now banned from broadcast anywhere in Belgium and all retail copies of the song (including the Ray Of Light album on which it appears) must be withdrawn. If EMI, Sony and Warner Music fail to enforce this they will be subject to a fine of €125,000. This case has been ongoing for eight years with both sides refusing to back down.
Salvatore Acquaviva claims that Madonna first heard Ma Vie Fout L’camp in the 1970s when she was working in Belgium as a backing singer and he gave her a tape. Madonna, on the other hand, denies that she was in Belgium at this time or ever hearing Acquaviva’s song. In addition to this she says that she did not compose andy of the music for Frozen herself.
No comment has been made from Madonna’s camp yet but Acquaviva’s lawyer told reporters, “We tried to reach a friendly agreement … but they didn’t want to negotiate so I sued for plagiarism. They have stolen a song, so they have to pay the value of the song.”
